Mykola Tomenko: New Legal Culture of Yanukovych Team: Implement only those Laws that you Support
Mykola Tomenko commented upon the explanations of the Viktor Yanukovych team concerning the declarations of the President at the PACE session in Strasbourg. The declarations stated that he denied the Holodomor as the genocide of the Ukrainian people, as he failed to uphold the Law on the Holodomor. Mykola Tomenko believes that "it is a new type of legal culture." "It looks like a new philosophy: not the classical anarchism, but the anarchism for the select few. I do not know any State leader, whose team would explain his right not to implement the laws by his failure to support them", the politician stated.
The Deputy Chairman stated that the President´s denial of the genocide had demonstrated a ‘high´ level of the legal culture of the authorities. "It is not the respect for the national history and its tragic moments that matters, but the fundamental legal culture", he stressed. "To make comparisons, if the President is authorized not to implement the laws he did not support, then the politicians should implement only the laws they supported, while the citizens only the laws they like", M.Tomenko stated.
M.Tomenko commented upon the explanations of the Party of Regions representatives that V.Yanukovych denied the Holodomor as the genocide, because it should be considered in compliance with the UN Convention of 1948. The Deputy Chairman reminded that the preamble of the Law included the following provision: "recognizing the Holodomor of 1932-1933 in Ukraine in compliance with the Convention of 9 December 1948 on the Prevention and Punishment of the Crime of Genocide." Clause 1 of the Law stated: "The Holodomor of 1932-1933 in Ukraine is genocide of the Ukrainian people."
The Deputy Chairman of The Verkhovna Rada of Ukraine stated that the Law of Ukraine "On the Holodomor of 1932-1933 in Ukraine" came into force on 28 November 2006, being supported by the BYuT Faction, Our Ukraine-People´s Self-Defence Faction, the Socialist Party Faction headed by the Chairman of The Verkhovna Rada O.Moroz, and two deputies of the Party of Regions Faction (H.Herman and T.Chornovil).
